ARTICLE 1 – PURPOSE
These Terms of Use (the “Terms”) govern access to and use of erverte.com (the “Website”), operated by ERVERTE SAS.
They apply to anyone who visits or uses the Website (the “User”).
Product purchases are governed by the General Terms and Conditions of Sale. In the event of any conflict concerning an order, the General Terms and Conditions of Sale prevail over these Terms.
Nothing in these Terms limits any mandatory consumer rights under applicable law.

ARTICLE 3 – ACCESS TO THE WEBSITE
Browsing the Website is free of charge, excluding any internet connection or equipment costs payable by the User to their own providers.
ERVERTE makes reasonable efforts to keep the Website accessible and operational. Certain features may be temporarily unavailable due to maintenance, updates or technical incidents.
Where reasonably possible, ERVERTE informs Users of scheduled interruptions that may significantly affect access to its services.
An interruption of the Website does not deprive customers of their rights concerning an existing order, withdrawal, return or statutory guarantee. Customer service remains available at contact@erverte.com.
ARTICLE 4 – CUSTOMER ACCOUNTS
Certain features may require identification or the use of a customer account.
Users must provide accurate information and keep the details needed to manage their accounts and orders up to date.
Users should take reasonable precautions to protect their login details and access codes. Any suspected unauthorised use of an account should be reported promptly to ERVERTE.
A User is not automatically liable simply because an action was performed through their account. Liability is assessed according to the circumstances and applicable law.
Users may request closure of their accounts by contacting contact@erverte.com. Account closure does not affect existing orders, the exercise of statutory rights or legal obligations to retain certain information.
ARTICLE 5 – ACCEPTABLE USE
Users must use the Website lawfully and respect the rights of ERVERTE and third parties.
In particular, Users must not:

impersonate another person or submit fraudulent information;

access an account, data or a protected part of the Website without authorisation;

introduce malicious software or interfere with the Website’s operation or security;

misuse forms or services for fraud, harassment or unsolicited communications;

reproduce or exploit Website content in breach of intellectual property rights;

These restrictions do not prevent activities permitted by law.
ARTICLE 6 – INFORMATION AND EDITORIAL CONTENT
ERVERTE takes reasonable care to provide accurate and up-to-date information. Any suspected error may be reported to contact@erverte.com so that it can be reviewed and, where necessary, corrected.
Articles published in the Journal are provided for general information. They may include analyses, sources and viewpoints relating to the subjects discussed. Information that may change over time should be considered in light of its publication or update date.
This content does not constitute individual professional advice.
This article does not limit ERVERTE’s obligations concerning the accuracy of essential product characteristics, pre-contractual information or commitments made to customers.
ARTICLE 7 – INTELLECTUAL PROPERTY
The texts, photographs, illustrations, videos, logos, graphics and other content on the Website are protected by applicable intellectual property laws.
They belong to ERVERTE or are used with the permission of their respective rights holders.
Any reproduction, adaptation, distribution or exploitation requiring the rights holder’s permission must be authorised in advance.
Statutory exceptions, including those relating to quotation and private copying where their conditions are met, remain applicable.
Access to the Website does not transfer ownership of any content to the User.
ARTICLE 8 – THIRD-PARTY LINKS AND SERVICES
The Website may contain links to third-party websites or incorporate features supplied by external service providers.
Users should review the terms and policies applicable when using those services.
ERVERTE does not control all content or practices of third-party websites. The inclusion of a link does not constitute a general endorsement of their content.
Using a technical provider or third-party service does not release ERVERTE from its own legal and contractual obligations, including its obligations towards customers.
ARTICLE 9 – PERSONAL INFORMATION AND COOKIES
The processing of personal information connected with use of the Website is described in the Privacy Policy.
That policy explains, among other things, the categories of information processed, how it is used, its recipients and the rights of the individuals concerned.
Users may exercise their rights by contacting contact@erverte.com, subject to applicable data protection rules.
Where consent is required for cookies or similar technologies, they must only be activated after that consent has been obtained. Users may change their choices through the “Cookie preferences” feature available on the Website.
Simply browsing the Website or accepting these Terms does not constitute consent to non-essential cookies or direct marketing.
ARTICLE 10 – LIABILITY
Each party is responsible for damage attributable to it in accordance with applicable law.
ERVERTE implements reasonable measures to maintain the Website’s operation and security but cannot guarantee uninterrupted availability or the absence of all incidents.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
These Terms do not impose a general cap on compensation or shorten any statutory period for bringing a claim.
Rights concerning orders, delivery, withdrawal and statutory guarantees remain governed by the General Terms and Conditions of Sale and mandatory applicable law.
ARTICLE 11 – RESTRICTION OR SUSPENSION OF ACCESS
In the event of unlawful use, fraud or a serious security threat, ERVERTE may take necessary and proportionate measures to protect the Website and its Users, including temporarily restricting access to certain features.
Unless urgent action is required, disclosure is prohibited by law or notification would compromise security, the affected User will be informed of the reasons for the measure and may contact ERVERTE to provide their observations.
An access restriction must not remove rights attached to an existing order or prevent the exercise of statutory rights. Customer service remains available by email.
ARTICLE 12 – CHANGES TO THESE TERMS
ERVERTE may update these Terms to reflect changes to the Website, its features or applicable law.
The update date appears at the beginning of this page. Changes apply prospectively and do not retrospectively alter existing contractual commitments.
Where advance notice or acceptance is required by law, ERVERTE will comply with that requirement.
ARTICLE 13 – GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by French law.
Where a User acts as a consumer and resides in another country, this choice of law does not deprive them of the protection provided by mandatory provisions of the law that would otherwise apply.
Consumers retain all mandatory rights and remedies available under applicable local law. Nothing in these Terms prevents a consumer from contacting a competent consumer protection authority, using an available local dispute resolution procedure, or bringing proceedings before a court having jurisdiction under applicable law. Referral to ERVERTE’s French consumer mediator is optional and is not a prerequisite for exercising those rights.

After submitting a prior written complaint to ERVERTE, consumers may, subject to the applicable admissibility requirements, refer their dispute free of charge to ERVERTE’s designated consumer mediator:

Nothing in these Terms imposes exclusive jurisdiction on the courts of Paris where this would conflict with mandatory consumer protection rules.
